2. Purposes, legal bases and categories of data

DREM processes personal data lawfully, fairly and transparently, only for specified, explicit and legitimate purposes, collecting only the data necessary for each purpose.

Each specific form provided by DREM (for example, statistical data requests, surveys, censuses, etc.) presents its own Data Protection Notice, which specifies the purposes, legal basis and retention periods applicable to that processing.

3. Recipients, processors and international transfers

Personal data may be disclosed to:

  • internal DREM services responsible for processing the request or service;
  • other public entities with legal competence, where this arises from a legal obligation or institutional cooperation (for example, Statistics Portugal - INE);
  • service providers contracted by DREM (processors), who process personal data on its behalf and according to documented instructions, under contracts that comply with Article 28 of the GDPR.

When service providers or platforms located outside the European Economic Area are used, DREM ensures that adequate data transfer mechanisms exist (such as European Commission standard contractual clauses), in accordance with Articles 44 to 49 of the GDPR.

4. Retention periods

Data is retained only for the period strictly necessary for the purposes that motivated its processing or for the time required by applicable legal or regulatory obligations.

DREM responds, as a rule, within a maximum period of 1 month from receipt of the request, which may be extended under Article 12(3) of the GDPR.

6. Security and confidentiality

DREM adopts appropriate technical and organisational measures to protect personal data against unauthorised destruction, loss, alteration, disclosure or access, taking into account the state of the art, implementation costs, the nature of the data and the associated risks.

7. Personal data breaches

In the event of a personal data breach likely to result in a high risk to the rights and freedoms of data subjects, DREM undertakes to:

  • notify the CNPD, where required, within a maximum of 72 hours after becoming aware of the breach (Articles 33 and 34 of the GDPR);
  • communicate the breach to the affected data subjects, where legally required.
